equality, diversity
& inclusion policy
Updated Friday 16 October 2026
Rhymes with Purple is committed to providing a supportive and inclusive culture for:
-
all those who need our services
-
our clients
-
our team and
-
other collaborators.
We recognise the positive value of diversity, promoting equality and fairness, and challenging discrimination.
We welcome our legal duties not to discriminate as a service provider and an employer.
We aim to go beyond the narrow scope of legislative compliance and follow best practices, making equality, diversity and inclusion a fundamental part of all our activities.
We recognise that people with different backgrounds, skills, attitudes and experiences bring fresh ideas and perceptions, and we wish to encourage and harness these differences to make our services more relevant and accessible.
We will not discriminate or tolerate discriminatory behaviour on the grounds of race, colour, sex, gender identity (transgender), disability, nationality, national or ethnic origin, religion or belief, marital/partnership or family status, caring responsibilities, sexual orientation, age, those identifying as non-binary, social class, educational background, employment status, working pattern, trade union membership or any other factor.
At Rhymes with Purple, we believe that Black lives matter. We stand in solidarity with the Black community against systemic racism, injustice, and inequality. We recognise our responsibility to actively listen, learn, and contribute to the structural changes required to build a fair and inclusive society. Our commitment to anti-racism is ongoing, and we pledge to embed these values into our workplace culture, our partnerships, and our services.
This policy relates to all aspects of work undertaken by Rhymes with Purple, including employment and recruitment and selection, meeting client’s needs and service delivery, and working with and supporting suppliers, supporters and other associated third parties.
values-aligned
working policy
Updated Friday 16 October 2026
Rhymes with Purple believes that the work we choose to make, support and promote matters.
We work with artists, organisations, festivals, venues, businesses and public bodies across theatre, circus, events and the Edinburgh Festival Fringe. We welcome a wide range of perspectives, creative approaches and subject matter, including work that is challenging, political, provocative or difficult.
At the same time, we reserve the right to decline projects, partnerships or clients where we believe our involvement would conflict with our values or contribute to avoidable harm.
We will not knowingly support work that promotes or legitimises discrimination, hate speech, harassment, dehumanisation or hostility towards marginalised or protected communities.
We may also decline work that involves deliberate misinformation, exploitative or unsafe working practices, misleading environmental claims or greenwashing, or where our involvement appears intended primarily to disguise or distract from serious harmful conduct.
We assess projects in context. The depiction of prejudice, violence, offensive beliefs or difficult subject matter does not in itself make a project unsuitable. Theatre and live performance often exist to examine uncomfortable ideas. We distinguish between work that explores, questions or challenges harm and work that actively promotes or materially contributes to it.
Where concerns arise, we may ask for further information or suggest changes to a project before deciding whether to proceed.
We also recognise that circumstances can change. If significant new information emerges after a project has begun, we reserve the right to review our involvement and, where appropriate and contractually possible, withdraw.
These decisions are made by Rhymes with Purple on a case-by-case basis. Acceptance of one project does not create an obligation to accept another, and declining a project does not necessarily represent a judgement on every aspect of the artist, organisation or individuals involved.
Our aim is simple: to work creatively, fairly and responsibly, while making space for ambitious art, difficult conversations and a broad range of voices.
If you are unsure whether a proposed project is a good fit for Rhymes with Purple, please contact us and tell us about it. We don't judge, but we may politely decline.
transgender inclusion
statement
Updated Friday 16 October 2026
At Rhymes with Purple, we want to provide a service where everyone is comfortable coming to us for advice and Production Services in a workplace where everyone belongs. At the same time, speaking up for people who face intense disadvantage, detriment and harm is also a crucial part of our belief. Bringing these elements together means we are a proudly trans-inclusive service, in line with our values and social justice approach to advancing equity, diversity and inclusion.
We are committed to providing equal opportunities and value for all, respecting the diversity of our team and clients. We believe everyone deserves to be treated with dignity and respect, regardless of gender identity or expression. We have a zero-tolerance approach to discrimination, victimisation or harassment based on a person’s gender identity. We have confidential and supportive methods of reporting experiences or witnessing bullying, harassment, and intolerance for clients and our team members.
We are committed to creating a welcoming and inclusive environment for all individuals, including those who identify as Trans (‘denoting or relating to a person whose gender identity does not correspond with the sex registered for them at birth.’). We have chosen ‘trans’ because it is one of the broadest and most widely accepted words in current use. However, we recognise it is not a term everyone uses and we recognise and respect everyone’s right to choose how they, as individuals, are described. As in any situation where opinions differ, we always encourage respectful dialogue, remembering there is a person behind the statement. We ask all team members to be mindful of discussions that affect some people more directly and personally than others.
We recognise the importance of using language affirming and respectful of trans individuals, and we will make every effort to use appropriate pronouns and terminology. We are committed to ongoing education and training for our team to ensure we provide the best possible service to all clients and collaborators.
We acknowledge that trans individuals face unique challenges and discrimination in our society, and we are committed to providing support and resources that are sensitive and responsive to their needs. We will work to ensure that our services are inclusive and accessible to all individuals, regardless of their gender identity or expression.
At Rhymes with Purple, we stand in solidarity with trans individuals. We are committed to advocating for their rights and working towards a society that is inclusive and accepting of all individuals, regardless of their gender identity or expression.
FRINGE PRODUCING, SUPPORT, CONSULTANCY & INTENSIVE SERVICE POLICY
Updated Friday 16 October 2026
These Terms apply to Fringe producing, support, consultancy and Producer Intensive services supplied by Rhymes with Purple (“RwP”, “we”, “us”) to the person, artist, company or organisation purchasing the service (“you”, “the Client”).
The specific service you have purchased, its price, inclusions, agreed responsibilities and any variations will be confirmed in writing and form part of these Terms.
1. Our Fringe Services
Rhymes with Purple offers four principal ways of working with artists and companies bringing work to the Edinburgh Festival Fringe.
The services involve different levels of responsibility. Purchasing advice or support from RwP does not automatically mean that RwP becomes the producer of your show.
1.1 Full Fringe Production
Full Fringe Production is our comprehensive producing relationship.
Under this package, Rhymes with Purple becomes part of your producing team and takes responsibility for the specific areas of the Fringe campaign agreed between us.
Depending on the needs of the production and your written agreement, this may include:
-
Fringe strategy and planning;
-
venue research and recommendations;
-
venue applications and negotiation;
-
liaison with venues and relevant Fringe organisations;
-
marketing strategy and oversight;
-
industry strategy and implementation;
-
sales monitoring and strategic response;
-
logistics and operational planning;
-
assistance with travel and accommodation arrangements;
-
locating or sourcing props, set, equipment or suppliers;
-
poster distribution management;
-
liaison with an external PR supplier where one is appointed;
-
regular producer meetings;
-
practical troubleshooting;
-
on-the-ground support during the Fringe; and
-
post-Fringe advice and planning.
The precise division of responsibility will be confirmed in your proposal or production agreement.
Where RwP has agreed to undertake a task, we will manage that task with reasonable care and skill. You must still provide information, approvals, materials, access and decisions reasonably required for us to do so.
Full Production does not mean that RwP assumes responsibility for every aspect of your production.
In particular, unless specifically agreed otherwise, the Client remains responsible for creating, rehearsing and delivering the show itself and for the responsibilities listed in section 4.
1.2 Fringe Support
Fringe Support is for artists and companies producing their own work who want structured access to an experienced Fringe producer.
You remain the producer of the show.
RwP provides advice, review, strategy and a professional sounding board. You and your team remain responsible for putting that advice into practice and completing the work.
The package currently includes, subject to your individual agreement:
-
an initial strategy session;
-
up to four scheduled producer consultations;
-
reasonable WhatsApp access for practical questions and light feedback during agreed working hours;
-
marketing plan review;
-
a pre-Fringe readiness review;
-
two scheduled Fringe check-ins;
-
an end-of-run review; and
-
access to relevant RwP Fringe guides, templates and resources.
Under Fringe Support, RwP does not, unless separately commissioned:
-
become the producer of your show;
-
submit venue applications;
-
negotiate contracts for you;
-
contact venues, suppliers or Fringe organisations on your behalf;
-
manage your deadlines;
-
run your marketing campaign;
-
create your marketing materials;
-
monitor sales daily;
-
book travel or accommodation;
-
manage performers or crew;
-
manage production logistics;
-
provide continuous on-site Fringe support;
-
provide unlimited consultancy; or
-
take responsibility for whether agreed actions are completed.
We may tell you what we believe needs to happen, when it should happen and how we would approach it. Completing it remains your responsibility.
1.3 Fringe Consultancy
Fringe Consultancy provides focused advice on particular questions, problems or decisions.
A standard consultation is a one-hour meeting, online or in person where available.
Subjects may include:
-
whether a production is ready for Edinburgh;
-
venue choice;
-
venue size and timeslot;
-
budgeting;
-
ticket pricing;
-
audience development;
-
marketing;
-
flyering;
-
industry strategy;
-
Fringe logistics;
-
production planning;
-
evaluating offers or proposals; and
-
defining realistic objectives for the Fringe.
You may provide relevant documents or materials in advance. Any review of those materials must be reasonable within the scope and preparation time of the consultation.
Where appropriate, we may provide brief follow-up notes or an action plan.
Consultancy does not include ongoing support after the session unless specifically stated.
It does not include:
-
producing your show;
-
project management;
-
implementation of our recommendations;
-
venue or supplier liaison;
-
completing applications;
-
running campaigns;
-
managing deadlines;
-
ongoing email or WhatsApp advice; or
-
responsibility for decisions subsequently made by you.
You may book additional consultancy sessions where available.
1.4 Fringe Producer Intensive
The Fringe Producer Intensive is a planning and strategy service intended to help artists build a practical Fringe plan before committing significant expenditure.
It is not a producing package.
The Intensive currently includes:
-
review of your completed pre-session questionnaire and relevant supplied materials;
-
preparation by your RwP producer;
-
a three-hour private working session;
-
budget planning and financial modelling;
-
venue strategy;
-
ticketing and income planning;
-
marketing and audience-development planning;
-
consideration of accommodation, travel and practical logistics;
-
identification of relevant deadlines;
-
a production timeline;
-
relevant templates and guides;
-
a personalised written Fringe Action Plan, normally approximately 5–8 pages, supplied within five working days of the session; and
-
one 30-minute follow-up call to be used within 30 days of the Intensive.
The purpose of the Intensive is to help you create a plan. You remain responsible for carrying out that plan.
Unless separately commissioned, RwP will not subsequently:
-
approach venues;
-
complete venue applications;
-
negotiate contracts;
-
book accommodation or travel;
-
hire staff;
-
contact suppliers;
-
implement the marketing plan;
-
monitor deadlines;
-
manage your production; or
-
act as your producer.
Advice given during an Intensive is based on the information available at the time. Fringe circumstances, prices, venue availability and your production may subsequently change.
2. What Your Package Includes
Your service includes only:
-
the services described for your package on the relevant RwP website page at the time you book;
-
the services described in your proposal, booking confirmation or contract; and
-
any additional services subsequently agreed in writing.
A reference to something during a conversation does not automatically add it to the scope of the service.
Where there is any conflict between general website information and a specific written proposal, booking confirmation or contract issued to you, the specific written agreement will take precedence.
Where the website describes a service as being available as an “additional service”, “extra service” or similar, it is not included in your package unless your agreement expressly says otherwise.
3. Initial Consultation and Project Suitability
We may ask prospective Full Production or Fringe Support clients to attend an initial consultation before confirming a package.
This allows us to understand:
-
your show and creative aims;
-
your experience of the Fringe;
-
your budget and practical circumstances;
-
what you hope to achieve in Edinburgh;
-
whether those expectations are realistic; and
-
what level of support is appropriate.
An initial consultation does not oblige Rhymes with Purple to accept the project.
We reserve the right to decline projects where we do not believe the relationship is a suitable creative, practical, financial or ethical fit.
Where appropriate, we may recommend a cheaper or lower level of service than the one originally requested.
4. Who Is Responsible for What
The package you purchase determines how responsibility is divided.
4.1 Full Production
For Full Production, RwP takes responsibility for carrying out the producing functions specifically allocated to us in your agreement.
The Client remains responsible for cooperating with RwP and providing information, materials, approvals and decisions within reasonable timescales.
Where our ability to complete a task depends upon information, approval, payment or material from you, we are not responsible for delays or consequences caused by that information, approval, payment or material being supplied late or incorrectly.
4.2 Fringe Support
For Fringe Support, the Client is the producer.
RwP advises, reviews, recommends and troubleshoots. The Client implements.
Advice from RwP does not transfer responsibility for the production, deadlines or implementation to RwP.
4.3 Consultancy and Producer Intensive
For Consultancy and the Producer Intensive, RwP provides professional advice and planning based upon the information supplied to us.
The Client decides whether to follow that advice and remains responsible for all subsequent implementation and decisions.
4.4 Responsibilities that normally remain with the Client
Unless specifically agreed otherwise in writing, the Client remains responsible for:
-
the creation and artistic quality of the production;
-
writing, directing, designing, rehearsing and performing the show;
-
ensuring performers and creatives are ready for the agreed performances;
-
recruiting and contracting performers and crew;
-
paying performers, crew and suppliers;
-
securing required intellectual-property, performance, music and image rights;
-
insurance;
-
employment obligations;
-
licensing;
-
safeguarding;
-
health and safety;
-
tax and financial obligations;
-
immigration, visa and right-to-work requirements;
-
complying with venue contracts;
-
supplying accurate information to venues, EdFringe and RwP;
-
ensuring that claims made about the production are accurate;
-
approving budgets and expenditure;
-
complying with applicable laws and festival rules; and
-
making the final artistic and financial decisions relating to the production.
We may advise on these matters from a producing perspective, but this does not constitute legal, accounting, tax, immigration or other regulated professional advice.
5. Client Cooperation and Deadlines
Fringe producing depends heavily upon deadlines.
You agree to provide information, materials, approvals and decisions reasonably requested by RwP within the timescale requested.
This may include:
-
scripts;
-
production descriptions;
-
biographies;
-
photographs;
-
artwork;
-
technical information;
-
budgets;
-
accessibility information;
-
marketing assets;
-
travel information;
-
cast details;
-
company information;
-
banking or payment information; and
-
approvals for expenditure or publication.
Where you miss a deadline, RwP will make reasonable efforts to minimise the consequences but cannot guarantee that the original outcome will remain possible.
We are not responsible for additional costs, reduced opportunities, missed application windows, delayed marketing, unavailable accommodation, unsuitable timeslots or other consequences caused by the Client failing to provide required information or decisions in reasonable time.
6. What We Do Not Promise
The Edinburgh Festival Fringe is unpredictable.
Experience, preparation and good producing can improve a production's chances, but nobody can guarantee its outcome.
Rhymes with Purple does not guarantee:
-
ticket sales;
-
audience numbers;
-
sell-out performances;
-
reviews;
-
particular star ratings;
-
press coverage;
-
awards or nominations;
-
industry attendance;
-
meetings with programmers or promoters;
-
touring opportunities;
-
transfers;
-
further bookings;
-
venue invitations;
-
future funding;
-
recoupment of your costs;
-
profitability; or
-
any particular artistic, commercial or career outcome.
We also cannot guarantee decisions or performance by organisations outside our control.
This includes:
-
acceptance by a particular venue;
-
a particular room, timeslot or performance schedule;
-
acceptance into the Fringe programme where another organisation controls eligibility;
-
approval of visas or immigration applications;
-
accommodation or travel availability;
-
prices quoted by external suppliers remaining available;
-
responses from venues, journalists, reviewers, industry professionals or suppliers;
-
coverage by a PR company or journalist;
-
attendance by invited industry or press;
-
reliable operation of third-party ticketing, advertising or booking platforms; or
-
the performance of independent contractors or suppliers.
Where we provide forecasts, budgets, audience estimates, sales projections or break-even calculations, these are planning tools based upon assumptions and information available at the time. They are not guarantees of financial performance.
Our obligation is to provide the agreed service with reasonable care and skill.
7. Marketing, PR and Publicity
The distinction between marketing and PR/press representation is important.
Full Production may include marketing strategy and oversight as described in your agreement.
Unless separately commissioned, this does not mean that RwP will personally create every piece of content, place every advertisement, manage every social-media account or supply all graphic design, photography, video, printing or flyering.
Those services may be provided separately by RwP, the Client or an external supplier.
PR representation and press-office services are not included in RwP's standard Fringe producing packages.
Where appropriate, we may:
-
recommend PR suppliers;
-
introduce you to a supplier;
-
share relevant production information with an appointed PR;
-
participate in strategy discussions; and
-
liaise with that supplier as part of Full Production.
The PR supplier remains responsible for its own work.
We cannot guarantee that journalists will attend, cover or review a production.
8. Industry Strategy
Where industry strategy is included, RwP may identify appropriate programmers, producers, venues, promoters or other industry contacts and may undertake reasonable outreach.
Industry professionals make their own decisions about what they see and who they meet.
RwP cannot require an invited person to attend a performance or meeting and does not guarantee that contact will result in further opportunities.
9. Travel and Accommodation
Where Full Production includes assistance with travel or accommodation, the nature of that assistance will depend on your agreement.
It may include research, recommendations, liaison or making bookings on your behalf.
Unless expressly agreed otherwise, travel and accommodation costs remain the Client's responsibility.
Where RwP makes an approved purchase or booking on your behalf, the Client is responsible for reimbursing that expenditure in accordance with the agreed arrangements.
RwP is not responsible for price increases, cancellations, availability problems or changes imposed by transport providers, accommodation providers or booking platforms.
10. Purchases, Hires and Third-Party Expenditure
Where appropriate under Full Production, RwP may purchase or hire goods or services on behalf of the production.
We will not normally incur significant expenditure without your approval.
Unless your agreement specifically states that a cost is included within the RwP fee, the Client remains responsible for the cost.
This may include:
-
props;
-
set;
-
equipment;
-
printing;
-
advertising;
-
photography;
-
video;
-
technical hires;
-
transport;
-
storage;
-
accommodation;
-
staffing; and
-
other production expenses.
Where practical, external contracts may be entered into directly between the Client and supplier.
Where RwP enters into an arrangement on the Client's behalf with the Client's authority, the Client remains responsible for the agreed cost.
11. Fees and Payment
Prices are those stated on the website, proposal or booking confirmation at the time of purchase.
For Full Fringe Production, the applicable retainer and payment schedule will be stated in your proposal or contract.
The retainer forms part of the total producer fee unless expressly stated otherwise.
For Fringe Support, Consultancy, the Producer Intensive and additional services, payment may be required in full at booking or according to an agreed payment schedule.
If an instalment remains unpaid for more than seven days after its due date, we may suspend services until the account is brought up to date.
A suspension caused by non-payment does not automatically extend deadlines or make RwP responsible for opportunities lost during that period.
Third-party expenditure is not included unless explicitly stated.
12. Additional Services and Expenses
Additional services may include:
-
flyering and street teams;
-
pre-Fringe postering;
-
graphic design;
-
website design;
-
marketing audits;
-
additional marketing assistance;
-
photography and videography;
-
dramaturgy;
-
script consultation; and
-
other project-specific services.
Prices are those stated on the website or subsequently agreed in writing.
Printing, venue costs, ticketing charges, advertising spend, accommodation, travel, freight, technical equipment and other external expenses are normally payable separately.
13. Meetings, Calls and Availability
Meetings and consultations are booked according to availability.
For scheduled Consultancy, Producer Intensive and Fringe Support sessions:
-
you may normally reschedule with at least 48 hours' notice;
-
cancellation or rescheduling with less than 48 hours' notice may result in the session being forfeited;
-
late arrival does not normally extend the session; and
-
if you are more than 15 minutes late without contacting us, we may treat the appointment as a no-show.
If Rhymes with Purple has to reschedule because of illness, emergency or circumstances outside our reasonable control, we will offer a reasonable alternative appointment.
Full Production clients receive meetings and communication according to the working arrangements agreed for their production.
14. Communication and Response Times
We aim to communicate clearly and within reasonable working hours.
Unless expressly stated otherwise, none of our packages provides 24-hour support, continuous monitoring or guaranteed instant responses.
WhatsApp access means that you may send reasonable production-related questions through the agreed channel. It does not mean that a producer is continuously available or that every issue will be answered immediately.
For Fringe Support, WhatsApp is intended primarily for practical questions and light feedback. Issues requiring detailed analysis may be reserved for a scheduled consultation or offered as an additional paid service.
During the Fringe, Full Production clients may receive enhanced practical support appropriate to their production. This does not mean that a particular member of RwP staff will be physically present or immediately available at all times.
Where something is genuinely urgent, we will make reasonable efforts to respond appropriately.
15. Advice and Client Decisions
Producing frequently involves judgement.
RwP may recommend a venue, timeslot, ticket price, marketing approach, budget, supplier, strategy or other course of action.
Recommendations are based upon our professional experience and the information available to us at the time.
Circumstances can change and reasonable professionals may reach different conclusions.
The Client remains responsible for final decisions unless authority to make a particular decision has expressly been delegated to RwP under a Full Production agreement.
RwP is not responsible merely because a reasonable professional recommendation subsequently produces a disappointing result.
16. Client Conduct
We expect clients, artists and collaborators to treat Rhymes with Purple staff, freelancers, suppliers and other artists with respect.
We will not tolerate:
-
harassment;
-
threats or abusive behaviour;
-
discriminatory language or conduct;
-
hate speech;
-
sexual harassment;
-
persistent unreasonable demands;
-
intimidation; or
-
behaviour that creates an unsafe working environment.
Serious or repeated breaches may result in termination of services.
17. Values and Project Suitability
Rhymes with Purple operates a values-aligned working policy.
We may refuse or withdraw from projects that we reasonably believe promote or materially contribute to:
-
discrimination;
-
hate speech;
-
harassment or dehumanisation;
-
serious exploitation;
-
deliberate misinformation likely to cause harm;
-
misleading environmental claims or greenwashing; or
-
harm against marginalised communities.
Challenging, political or controversial subject matter is not itself grounds for refusal. We consider context, intent and likely impact.
If significant concerns arise after we have accepted a project, we may discuss those concerns with you and, where necessary and contractually possible, end our involvement.
18. Confidentiality
We will treat non-public information you provide about your project as confidential.
We will not disclose confidential material except:
-
with your permission;
-
where required by law;
-
where reasonably necessary to provide the agreed service;
-
to professional advisers who are themselves subject to appropriate confidentiality obligations; or
-
where disclosure is reasonably necessary to protect the safety or legal rights of Rhymes with Purple or another person.
You must also respect confidential information shared with you by Rhymes with Purple, our team or other clients.
19. Recordings and Meetings
You must not record private meetings, consultancy sessions or calls without the consent of everyone participating.
If recording is agreed, the permitted use of the recording should also be agreed.
Rhymes with Purple will not publish or share private information about your project without permission except where anonymised so that no individual or production can reasonably be identified.
20. Materials and Intellectual Property
Templates, guides, spreadsheets, checklists, frameworks and other resources supplied by Rhymes with Purple remain our intellectual property unless otherwise stated.
You may use and adapt them for your own production and internal team purposes.
You must not:
-
resell them;
-
publish them;
-
distribute them outside your production team;
-
upload them publicly;
-
use them to create competing commercial products; or
-
remove RwP branding or copyright notices where present.
The intellectual property in your production remains yours or that of the relevant rights holder.
21. Marketing Materials, Information and Approvals
Where Rhymes with Purple creates, commissions, submits or distributes material on your behalf, you are responsible for ensuring that factual information supplied by you is accurate.
We may rely upon information supplied by you, including:
-
biographies;
-
credits;
-
production descriptions;
-
dates;
-
venue information;
-
awards;
-
quotations and reviews;
-
accessibility information;
-
photographs and artwork; and
-
claims about the production.
You are responsible for ensuring that material supplied to RwP can lawfully be used.
Where approval is requested, the Client is responsible for reviewing the material promptly and notifying us of factual errors before publication where reasonably possible.
RwP is not responsible for errors contained in information supplied or approved by the Client.
22. Cancellation by the Client
Cancellation rights depend upon the service purchased, when work has begun and whether digital materials, preparation or booked professional time have already been supplied.
Where applicable, statutory consumer cancellation rights will be respected.
If you ask us to begin providing services during any statutory cancellation period, you may be required to pay for work already carried out if you subsequently cancel.
Where a Full Production project is cancelled after work has begun, fees already paid may be non-refundable and further fees may become payable according to work completed and contractual commitments already entered into.
Preparation for Consultancy or a Producer Intensive may constitute part of the service where RwP has already reviewed materials or prepared specifically for your appointment.
Any specific cancellation schedule contained in your proposal or contract takes precedence over this general clause.
23. Cancellation or Withdrawal by Rhymes with Purple
We may withdraw from a project where:
-
you materially breach these Terms;
-
agreed payments remain outstanding;
-
you repeatedly fail to provide information required for us to perform the service;
-
your conduct towards our staff, freelancers or collaborators is unacceptable;
-
continuing the relationship would create significant legal, ethical or reputational risk;
-
the project becomes impractical or impossible to deliver;
-
required rights, permissions, funding or venue arrangements cannot be secured;
-
circumstances change so substantially that the agreed service can no longer reasonably be provided; or
-
there has been a serious breakdown in the working relationship.
Where possible, we will discuss concerns with you before ending the relationship.
Any refund or outstanding payment will depend upon the circumstances, work already undertaken and your specific agreement with us.
24. Events Outside Our Control
We are not responsible for failure, disruption or delay caused by circumstances outside our reasonable control.
These may include:
-
venue closure;
-
festival cancellation or substantial alteration;
-
extreme weather;
-
transport disruption;
-
serious illness;
-
industrial action;
-
government restrictions;
-
public-health emergencies;
-
technical failures;
-
utility outages;
-
interruption or failure of third-party websites or platforms;
-
action or inaction by venues or festival bodies; or
-
failure of independent suppliers.
Where reasonable and possible, we will work with you to identify an alternative.
25. Third Parties
We may recommend venues, PR companies, designers, printers, technicians, marketers, accommodation providers, performers, photographers, videographers or other suppliers.
A recommendation means that we believe the supplier may be suitable based upon the information reasonably available to us. It is not a guarantee of that supplier's performance.
Unless we specifically contract a supplier on your behalf as part of Full Production, any agreement you enter into is between you and that third party.
We are not responsible for the acts, omissions, quality of work, cancellation or insolvency of independent third-party suppliers.
26. Changes to the Production
Fringe productions change.
If the scope, scale, venue, schedule, run length, company size, technical requirements or other needs of the production change significantly after our agreement is made, the original scope of RwP's service may also need to change.
We may need to revise:
-
the work we provide;
-
deadlines;
-
staffing;
-
responsibilities;
-
expenses; or
-
fees.
We will discuss material changes with you before making substantial alterations to the agreed service.
A significant expansion of the production does not automatically become part of RwP's existing fee.
27. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to this, Rhymes with Purple will not be liable for indirect or consequential losses, or for loss of profit, opportunity, reputation, anticipated savings or future bookings arising from the Fringe performance of your production.
Where permitted by law, our total liability connected with the purchased service will not exceed the fees paid to Rhymes with Purple for that service.
28. Data Protection
Personal information will be handled in accordance with applicable UK data-protection law and our Privacy Policy.
Where third-party services such as WhatsApp, Google Meet, Zoom, Wix, Google Drive or other cloud services are used, those services may process personal information under their own privacy terms.
29. Governing Law
These Terms and any dispute arising from them are governed by the laws of Scotland.
The Scottish courts will have jurisdiction over disputes arising from the agreement, subject to any statutory consumer rights that require otherwise.
